hese General Conditions of Sale are concluded: On the one hand by Kriter Brut de Brut, a simplified joint-stock company with a capital of €39,000,000 whose registered office is located at P.O Box 70010 21200 BEAUNE, registered in the DIJON Trade and Companies Register under SIRET number 343 484 879 000 14 Hereafter referred to as "The Service Provider" And, on the other hand, by any legal or natural person wishing to make a purchase via Patriarche's website Hereafter referred to as "The Customer".
1) Purpose of the Contract
The purpose of these General Conditions of Sale is to establish the contractual provisions between the Service Provider and the Customer and the conditions applicable to any reservation of services proposed through the www.patriarche.com websitefor the consumer. The acquisition of one of these services through this website implies unreserved acceptance by the Customer of these General Conditions of Sale.
2) Legal Information
Ruling number 59-107 of January 7, 1959 and Law number 74-631 of July 5, 1974 prohibit the selling and offering of alcoholic drinks to minors and similar persons. Consequently, by completing your pre-reservation form, you acknowledge that you are legally authorised to conclude this contract. In accordance with the provisions of Law number 78-17 of January 6, 1978, the www.patriarche.com website has been formally registered with the National Commission for Information Technology and Civil Liberties. In accordance with the French Data Protection Act, the information that is requested from you is essential for the processing of your reservation and is intended for the services of the Service Provider. You have the right to access, modify, delete and correct information relating to your personal data. Through us, you may receive proposals from other companies. If you do not wish to receive such proposals, simply write to us indicating your surname, first name(s), address, and customer number if applicable. The exercising of this right must be made: 1. By post to PATRIARCHE, For the attention of Christine RICHARD, P.O. Box 70010, 21200 BEAUNE. 2. By e-mail to firstname.lastname@example.org with proof of your identity.
3) Characteristics of the Items proposed for Reservation
The proposed services are those which appear on the www.patriarche.com website. These services are proposed within the limit of the number of places available. However, an insufficient number of participants will be considered by the Service Provider as grounds for cancellation for certain types of services under the conditions provided for in Article 9-3 of these general conditions. Each service is accompanied by a description established by the Service Provider. The photographs published on the www.patriarche.com website are as accurate as possible.
4) Geographical Area
Online pre-reservation or reservation of the services presented on the website is open to any person of adult age without limitation as to their territorial origin.
The prices appearing on the www.patriarche.com website are in Euros and are inclusive of VAT at the rate applicable on the day the service is reserved; any change in the tax rate may be applied to the price of the services. The Service Provider reserves the right to modify its prices at any time, with it being understood that the price appearing on the www.patriarche.com website on the day of the pre-reservation will be the only one applicable to the Customer. The prices indicated do not include travel expenses that have been incurred in order to benefit from the services. There are no shipping costs, customs taxes or other formalities in order to benefit from the wine-related tourism services proposed by the Service Provider on the www.patriarche.com website.
6‐1) Pre-Reservation Process
The Customer pre-reserves on the www.patriarche.comwebsite. To reserve one or more services, the following pre-reservation process must be followed:
¤ The Customer makes their choice from among the service(s) proposed.
¤ They complete an online pre-registration form on which they will provide all the details requested. The collection of this data is notably to facilitate the Customer's identification by the Service Provider and thus enable the monitoring of the business relationship for the smooth running of the reservation process.
¤ By ticking the box provided for this purpose, the Customer acknowledges having read and accepts these General Conditions of Sale.
¤ Lastly, they finalise their pre-reservation by clicking on the "Validate" button.
Once the Customer has validated their pre-reservation, the Service Provider will contact them at the e-mail address indicated in order to finalise the order which is equivalent to a reservation. A copy in PDF format of these General Conditions of Sale, which the Customer has been requested to review on the www.patriarche.com website upon making their pre-reservation, is available on the website. If the Customer chooses to pay by bank transfer, the Service Provider will provide its bank account details. The reservation becomes binding when the total price has been paid to the Service Provider. The Customer will receive an e-mail from the Service Provider confirming the safe receipt of their payment. The Service Provider reserves the right to cancel any reservation from a Customer with whom there is a dispute relating to the payment of a previous reservation or a Customer who is unauthorised to enter into and sign contracts. Any pre-reservation implies acceptance of the prices and descriptions of the items available for sale.The Service Provider undertakes to honour pre-reservations received on the website only within the limit of the number of places available. However, an insufficient number of participants will be considered by the Service Provider as grounds for cancellation for certain types of services under the conditions provided for in Article 9-3 of these general conditions.
6‐2) Reservation Deadlines
In view of the specificity of the services proposed by the Service Provider, no request for pre-reservation may be made within eight days before the start date of the services, with the exception of the Free Visit.
7) Terms of Payment
Payment of purchases is done via one of the following means, at the Customer's convenience:
¤ By secure payment on the website
¤ By bank card
¤ By bank transfer
¤ By bank cheque to be sent to the postal address given: PATRIARCHE, For the attention of Christine RICHARD, P.O. Box 70010, 21200 BEAUNE
8‐1) Duration of the Service
The Customer is informed of the given length of the service when browsing the www.patriarche.com website and upon receiving the reservation confirmation sent by the Service Provider. Under no circumstances may the Customer claim/invoke any right to remain on the premises once the service has ended.
8‐2) Arrival at the Premises of the Service
The Customer must be present on the day specified and according to the schedules mentioned in the reservation confirmation document which they have been sent by the Service Provider. They must be able to present their visit confirmation document at the reception desk. If this is not possible, they undertake to inform the Service Provider. In case of late arrival or last-minute impediment, the Customer must notify the Service Provider whose address and telephone number appear on the reservation confirmation.
The Customer must be able to present their visit confirmation document at the reception desk, failing which they will be refused access to the site.
8‐3) Suspension of the Service
If the service is suspended by the Customer, no refund will be provided in this case.
8‐4) Inability to provide Part of the Service
If the Service Provider is unable to provide a significant part of the scheduled services and propose any replacement solutions, the Customer will then be refunded the difference in price as evaluated.
For each service purchased that entitles one visit and one wine-tasting, the Customer cannot ask for a price reduction, refund or any benefit (credit) or compensation in the event that they have not used part of the services, for any reason whatsoever. Thus, for those unable or not wishing to consume wine, a soft drink may be proposed instead of the alcoholic drink, provided that this information has been communicated to the Service Provider beforehand and in any case at least 48 hours in advance. The Customer already undertakes not to object to this and not to claim any price reduction, refund, benefit or compensation due to the non-consumption of wine provided for in the service purchased.
9‐1) Cancellation due to the Customer
Any cancellation must be reported to the Service Provider by e-mail to email@example.com. The reservation number must be specified. For any cancellation within ten (10) days, a penalty of 50% of the total cost of the service will be applied. For any cancellation within eight (8) days, a penalty of 100% of the total cost of the service will be applied. In case of a no-show by the Customer, a penalty of 100% of the total cost of the service will be applied.
9‐2) Cancellation due to the Seller
In view of the specificity of the services being sold, the Service Provider reserves the right to cancel the proposed service within no more than 10 days prior to the date of the service. The Service Provider informs the Customer of this right when sending the reservation confirmation. The Customer will be fully refunded for the amounts paid, without compensation from the Service Provider, or will be offered another date wherever possible. Only the costs incurred in connection with one or more of the reserved wine-related tourism services will be refunded. No other request will be accepted by the Service Provider.
The Service Provider shall not be held liable when its inability to execute the contract has been notified, in the event of force majeure and, notably in case of total or partial strike, flood, fire or other natural disasters and, generally, any event not allowing for the proper execution of the reserved service.
Computerised registers, stored in the Service Provider's computer systems under reasonable security conditions, will be considered as proof of communications, reservations and payments made between the parties.
12) Settlement of Disputes
These General Conditions of Sale are governed by French law. Our customer service is available to you for the settlement of any dispute and, failing an out-of-court solution, the dispute will be brought before the court having jurisdiction.
No insurance is included in the prices proposed on the website.
13‐1) Damage caused by the Customer
Any damage caused by the Customer shall result in them being liable for such damage. They are invited to take out holiday insurance cover in order to protect themselves against these different risks.
13‐2) Damage caused by the Service Provider
In addition to the cases provided for in Article 10, the Service Provider may be held liable for any other damage. For this purpose, the Service Provider has taken out third-party liability insurance with the company GRAS SAVOYE under policy number 7 110 519.

16. Health Notices and Warnings
ALCOHOL ABUSE IS DANGEROUS TO YOUR HEALTH - CONSUME AND ENJOY IN MODERATION.
The Service Provider draws the Customer's attention to the risks related to driving a vehicle after the consumption of alcohol. It urges the Customer to take all necessary precautions in this case and shall not be held liable for the consequences of excessive drinking.
